Vehicular Homicide: NRS § 484C.130
Under Nevada law (NRS § 484C.130), vehicular homicide is defined as causing the death of another person while driving under the influence of alcohol or drugs and having three or more prior DUI convictions. Because vehicular homicide is seen as a crime that only repeat offenders can commit, this felony charge is pursued aggressively by prosecutors.
To secure a conviction for vehicular homicide, the prosecution must prove several elements beyond a reasonable doubt, including:
- You were driving or in actual physical control of a vehicle;
- You were under the influence of alcohol, drugs, or a combination of both; and,
- Your impaired driving proximately caused the death of another person.
- As mentioned, you must also have at least three prior DUI convictions.
Unlike vehicular manslaughter, which involves simple negligence, vehicular homicide is considered a Category A felony, which is the most severe classification of felony in Nevada law. Attorney Goodman understands the distinction between these charges and how to challenge the state’s attempt to land a conviction.
