Vehicular Homicide: NRS § 484C.130

Under Nevada law (NRS § 484C.130), vehicular homicide is defined as causing the death of another person while driving under the influence of alcohol or drugs and having three or more prior DUI convictions. Because vehicular homicide is seen as a crime that only repeat offenders can commit, this felony charge is pursued aggressively by prosecutors.

To secure a conviction for vehicular homicide, the prosecution must prove several elements beyond a reasonable doubt, including:

  • You were driving or in actual physical control of a vehicle;
  • You were under the influence of alcohol, drugs, or a combination of both; and,
  • Your impaired driving proximately caused the death of another person.
    • As mentioned, you must also have at least three prior DUI convictions.

Unlike vehicular manslaughter, which involves simple negligence, vehicular homicide is considered a Category A felony, which is the most severe classification of felony in Nevada law. Attorney Goodman understands the distinction between these charges and how to challenge the state’s attempt to land a conviction.

Penalties for Vehicular Homicide in Nevada

As a Category A felony, a conviction for vehicular homicide can result in decades behind bars or even a life sentence. The sentencing range reflects how seriously Nevada courts treat DUI fatalities, particularly when the driver has prior offenses on record.

If convicted, the penalties for vehicular homicide may include:

  • 25 years to life in Nevada state prison
  • Eligibility for parole only after serving 10 years
  • Revocation of your Nevada driver’s license
  • Thousands of dollars in fines, restitution, and court fees
  • Felony record that can never be sealed or expunged

In addition to the criminal penalties, you may also face civil wrongful death lawsuits from the victim’s family. Although a civil case is treated separately from a criminal case, a conviction in a criminal case could strengthen the arguments of the civil case.

Defense Strategies for Vehicular Homicide Charges

No attorney can promise which defenses will apply to your case, but Attorney Ross C. Goodman has decades of experience identifying weaknesses in DUI-related homicide prosecutions, so he can often consider multiple angles when protecting a client from a vehicular homicide charge.

His defense strategies sometimes focus on exposing the flaws in the state’s evidence, including the investigation, testing, and chain of custody.

Depending on your case, possible defenses may include:

  • Challenging the blood or breath test results, including issues with calibration, contamination, or improper administration.
  • Questioning the cause of death, especially in multi-vehicle collisions.
  • Disputing the presence of impairment, such as when the test results are borderline or when medications were lawfully prescribed.
  • Criticizing the usefulness of the traffic investigation, including flawed accident reconstruction or missing physical evidence.
  • Arguing that prior DUI convictions were invalid or inadmissible.

Attorney Goodman prepares every case as if it’s going to trial, especially in high-category felony cases. He has earned a reputation among Las Vegas judges and district attorneys as a defense lawyer who doesn’t bluff, and who is ready to fight when his client’s freedom is at stake.

"This is the kind of attorney you don’t just recommend — you insist people hire. Worth every penny."
Ross Goodman is, without question, in a league of his own. From our very first meeting, it was clear this wasn’t just another defense attorney — Ross is the real deal. He knows the system, commands respect in the courtroom, and he knows how to get results when it matters the most.

To be completely honest, we didn’t hire Ross right away — and that was our first mistake. We initially went with another well-known law firm, thinking we were getting a specific high-profile attorney. But when it came time for court, instead of the person we were promised, they sent in a junior lawyer we’d never met. I couldn’t even get straight answers to basic questions, and it quickly became clear that we were just another file on someone’s desk.

That experience made me double down and insist that we bring Ross Goodman onto the case. I had already met with him in person and had done my homework. After spending an entire afternoon watching interviews, YouTube clips, and reading about his background (and his incredible family — yes, I’m now also a fan of his dad, Oscar Goodman), I knew this was the attorney we had to have. Thankfully, we made the switch — and everything changed.

He took a very serious situation and turned it into a manageable, strategic resolution. He negotiated a plea that avoided a felony conviction — something we honestly didn’t think was possible. That outcome didn’t happen by chance — it happened because he knows how to talk to prosecutors, how to protect his clients when the stakes are high, and how to be the very best at what he does.

He’s not the cheapest attorney in town — and that’s exactly the point. If you’re gambling with your freedom, your record, or your future, you want someone with real experience and a proven reputation. You don’t hire Ross to hope for a good outcome , you hire him because you want the best possible one.

    "Don't hesitate, hire him immediately!"
I had met with Ross in his office and within three seconds I knew I had to hire him. His right hand Tiffanie was professional and friendly and kept me informed of all court dates, which Ross appeared twice on my behalf without me even having to show up. I

"I switched and hired Mr. Goodman and could not have been more impressed with the outcome. You do get what you pay for."
I met with Mr. Goodman who answered all my questions and knew his stuff.  I decided to hire a less expensive attorney but was not happy with the progress ended up being a waste of money with the other guy. I switched and hired Mr. Goodman and could not have been more impressed with the outcome. You do get what you pay for. I should have gone with my gut reaction at the beginning that would have saved me anxiety, time, and money. Don’t make the same mistake.
