What Constitutes a DUI Charge?

Before diving into the defenses and penalties associated with a DUI charge, it's crucial to understand what exactly constitutes a DUI. The laws might seem straightforward, but nuances often come into play, making it essential to be fully informed. 

  • Blood Alcohol Concentration (BAC). Driving with a BAC of 0.08% or higher is typically considered “under the influence.” This percentage is the standard for drivers over 21. However, lower thresholds exist for commercial drivers and those who are under 21.
  • Impairment by Drugs. DUI isn't limited to alcohol consumption. Driving under the influence of drugs, whether prescription, over-the-counter, or illegal, can also lead to a DUI charge if they impair your ability to operate a vehicle safely.
  • Observable Impairment. Even if your BAC is below 0.08%, you can still be charged with DUI if your driving behavior suggests impairment. Swerving, erratic braking, or other indicators might lead law enforcement to suspect DUI.
  • Refusal to Test. In some jurisdictions, refusing to undergo a breathalyzer test or provide a blood sample when suspected of DUI can result in automatic penalties. Knowing your rights and the consequences of refusing such tests in your area is crucial.
  • Zero Tolerance for Underage Drivers. For drivers under the legal drinking age, any detectable amount of alcohol can lead to a DUI charge. The regulations are strict to discourage underage drinking and driving.

Penalties for First DUI Conviction

DUI charges are taken seriously in Clark County and across Nevada. The penalties can be severe for first-time offenders, but with an experienced attorney, you stand a better chance of receiving a favorable outcome. Potential penalties include:

  • License Suspension. A first-time DUI offense can lead to a suspension of your driving privileges for 90 days by Nevada’s Department of Motor Vehicles. A restricted license can be temporarily granted after 45 days if the defendant has not committed any further offenses.
  • Fines. Up to $1,000 in fines, in addition to court costs (currently around $600 in Nevada)
  • Suspended Jail Sentence. Those convicted may not have to face jail time unless they violate anything related to their sentence; if this occurs, they face up to six months of jail time or 96 hours of community service. 
  • Mandatory DUI Classes. Offenders may be required to attend educational classes on alcohol and its effects or undergo an alcohol assessment. This is at the defendant’s expense. They may also be required to attend a Nevada Victim Impact Panel lecture, also at their expense.
  • Installation of a Breath Interlock Device. If the defendant’s BAC exceeded 0.18 at the time of their arrest, they may be mandated to install and maintain an ignition interlock device on their vehicle for a period of three years, at their own expense.

  • Improper Procedure. Sobriety tests must be accurately carried out, or the results may be deemed inadmissible. 
  • Medical Conditions. Some medical conditions can mimic signs of intoxication. Conditions like hypoglycemia or fatigue can result in symptoms mistaken for drunkenness.
  • Chain of Custody. Any errors in the handling, storing, or testing your blood sample, could be used in your defense.
